Mythical Racism in Enforcement Program

New York Governor Andrew Cuomo announced last week that our state will no longer participate in the Secure Communities program. New York is the second state to choose not to participate in this federal immigration enforcement program.
Secure Communities is an information sharing program between state, local and federal enforcement agencies. It gives the FBI access to fingerprints taken by local police; after a person is in custody, who then shares this information with Homeland Security.
“There are concerns about the implementation of the program as well as its impact on families, immigrant communities and law enforcement in New York,” wrote Cuomo in a letter to the Department of Homeland Security. “As a result, New York is suspending its participation in the program.”
24 New York State County Sheriff’s Departments are already participating in this program, with Putnam, Dutchess and
Rockland Counties being among the first.
What is it that our Governor doesn’t understand? Certainly those Sheriff’s that entered the program, have, by oath adopted the proposition that they will honor the “rule of law” by enforcing the law consistently without prejudice and in defiance of external influences. While supporters of Cuomo’s decision will argue that that ‘situational discretion’ (compassion) remains an attribute of professional law enforcement, permitting compassion in the enforcement of law for an entire population of people (illegal aliens) would violate the rule of law as it is commonly understood. How can Governor Cuomo intelligently take the position that crime will not be reported if law is enforced? Isn’t the opposite true? That the uniform enforcement of the law creates an expectation of certainty for the public and for the criminal element that our laws are intended to deter?
The Governor’s decision to pander to La Raza with his refusal to report law violations to federal authorities not only facilitates criminal illegal aliens to remain in NY, but exposes our State, our Sanctuary Government, to liability exposure for every crime committed by the illegally present foreign national criminal and inspires further criminal activity by evidencing our Governor’s disinterest in the enforcement of all law.
Favoring the rule of law isn’t mean spirited or racist – it is the very foundation of the United States and is at the core of why America can welcome immigrants.
We have by far the most generous legal immigration system in the world, admitting 1 million immigrants each year. That has always been a net benefit for the United States. However, illegal immigration puts a strain on our economy, schools and hospitals and even poses serious national security threats. Enforcing all of our laws – including immigration laws – is critical to our success and sovereignty as a State and Nation.
Immigration laws do not discriminate against individuals based on their color, creed, gender or ethnic background. Instead, the law makes a distinction between law-keepers and lawbreakers. A crime is a crime, no matter who commits it.
The United States was founded upon the rule of law, and pro-enforcement policies uphold this American legacy. The Internal Revenue Service enforces tax law even though the majority of Americans do not enjoy paying taxes. Why? Because all Americans are required to play by the same rules.
The same goes for immigration laws. Governor Cuomo’s decision on Secure Communities sends the message to illegal immigrants and illegal border-crossers that we do not take our immigration laws seriously. We are a nation of immigrants, but in order to sustain the high levels of legal immigration we have, immigration laws must be enforced uniformly. Allowing already incarcerated aliens in NY jails to evade our laws will result in New Yorkers being further victimized by criminal illegal aliens.
